In the 2005 Kitzmiller v Dover Area School Board case, a federal district court ruled that Intelligent Design creationism was not science, but a disguised religious view and that teaching it in public schools is unconstitutional. But creationists contend that it is illegitimate to distinguish science and religion, citing philosophers Quinn and especially Laudan, who had criticized a similar ruling in the 1981 McLean v. Arkansas creation-science case on the grounds that no necessary and sufficient demarcation criterion was (...) possible and that demarcation was a dead pseudo-problem. This article discusses problems with those conclusions and their application to the quite different reasoning between these two cases. Laudan focused too narrowly on the problem of demarcation as Popper defined it. Distinguishing science from religion was and remains an important conceptual issue with significant practical import, and philosophers who say there is no difference have lost touch with reality in a profound and perverse way. The Kitzmiller case did not rely on a strict demarcation criterion, but appealed only to a “ballpark” demarcation that identifies methodological naturalism (MN) as a “ground rule” of science. MN is shown to be a distinguishing feature of science both in explicit statements from scientific organizations and in actual practice. There is good reason to think that MN is shared as a tacit assumption among philosophers who emphasize other demarcation criteria and even by Laudan himself. (shrink)

The controversies in Bristol, Alder Hey and elsewhere in the UK surrounding the removal and retention of human tissue and organs have led to extensive law reform in all three UK legal systems. This paper reports a short study of the reactions of a range of health professionals to these changes. Three main areas of ethical concern were noted: the balancing of individual rights and social benefit; the efficacy of the new procedures for consent; and the helpfulness for professional practice (...) of the new legislation and regulation. Recognition of these concerns may help in forging a new partnership between professionals and patients and their families. (shrink)

BOOK REVIEW: Through fifteen interrelated essays, Daniel Campos’ Loving Immigrants in America reflects upon his experiences as a Latin American immigrant to the United States and develops an experiential philosophy of personal interaction. Building upon previous work, Campos’ implicit conceptual framework comes from Charles S. Peirce’s dual philosophical accounts of the evolution of personality and evolutionary love. But the flesh and blood of the book are Campos’ own personal experiences as an immigrant who has labored for more than twenty years (...) to make himself at home in the United States, aka la Yunai, by growing to love an impressively broad range of places and people across the country. Campos begins in rural Arkansas (where he arrived as an eighteen-year-old from Costa Rica to study at a small religious liberal arts college), travels extensively across the Deep South (in a series of road trips described in Chapters 3-6), completes an MA in Statistics and later a PhD in Philosophy at Penn State, and eventually settles to teach at Brooklyn College where he is surrounded by immigrants from all over the world. The book’s cast of characters and Campos’ interactions with them are so extensive as to defy generalization, but careful readers are likely to walk away convinced of Campos’ claim that “anyone who is receptive and attentive to the commonality of human experience can empathize with immigrants” (2). This paper discusses the judgment of Judge William Overton in McLean vs. Arkansas Board of Education (1982), and the subsequent philosophical literature that discusses this judgment.

The lodestone is an extremely rare form of the mineral magnetite that occurs naturally as a permanent magnet. It therefore attracts metallic iron as well as fragments of ordinary ‘inert’ magnetite. This ‘magic’ property was known to many ancient cultures, and a powerful lodestone has always commanded a high price. By the eleventh century AD the Chinese had discovered that a freely suspended elongated lodestone would tend to set with its long axis approximately north–south, and utilized this property in the (...) magnetic compass. They also appear to have discovered that this invaluable characteristic could be handed‐on to a steel needle if the latter were contacted with, or stroked by, a lodestone.The magnetism of the lodestone was scientifically investigated by William Gilbert in the sixteenth century, when he defined its ‘poles' and the well‐known rule that ‘like poles repel, unlike attract’. He also studied ‘inclination’ and ‘variation’, and means to aid the preservation of magnetic power. How to concentrate it by ‘arming’ the lodestone with caps or pole‐pieces of soft iron was discovered in the same century. These methods have been repeated, confirmed, and improved. The lodestone occupies a vital place in the history of magnetism, but little beyond Gilbert's work can be reached by historical studies because vastly improved steel or alloy permanent magnets, and electromagnets, replaced it before quantitative measurements were developed. These techniques have therefore been applied retrospectively to both museum specimens and contemporary natural lodestones. A good source of the latter was found to be the igneous complex known as Magnet Cove, Arkansas, and this material has been used as the ‘type example’. All specimens were discrete, well‐rounded, rusty brown pebbles found near the surface. Their unweathered interiors were black titanomagnetite. No significant trace element or crystallographic differences could be found between the lodestones and the magnetically inert material that always accompanied them. The magnetic moment per unit volume of the ‘as‐found’ Magnet Cove lodestones varied between 6.5 and 11.6 emu cm−3, which compares poorly with the hundreds of units characteritzing modern permanent magnets. Hysteresis loops gave a saturation intensity of 27–51 emu cm−3, suggesting that intensity has diminished since formation. This agrees with general experience of magnets, especially in the absence of a ‘keeper’. The initial volume susceptibility of Magnet Cove magnetite was about 0.18 for low fields, and always remained <1. This means that a normal terrestrial magnetic field with a maximum vector <1 Oe is unable to induce even the low magnetic moments we see today, while a field approaching 1000 Oe is required for saturation. These parameters, and the rare occurrence of lodestones as near‐surface fragments, support suggestions that they are the product of a lightning strike upon an exposure of a suitable magnetite. Transient currents averaging 30 000 A have been measured. This would give rise to a zone of potential magnetic saturation at least 12 cm in diameter, to which some of the ejected fragments would be exposed. An attempt to determine the period elapsed since formation of the Magnet Cove lodestone was made by annealing magnetically saturated specimens at temperatures up to 500°C, and measuring J v at weekly intervals for 100 days. The decay curves visually resembled exponential functions, but mathematical tests proved that they were not strictly so. Interpretation was therefore difficult, but a pragmatic procedure involving excessive extrapolation suggested an ‘age’ of about 3500 years. (shrink)

ABSTRACTThis report on end‐of‐life decision‐making in Canada was produced by an international expert panel and commissioned by the Royal Society of Canada. It consists of five chapters.Chapter 1 reviews what is known about end‐of‐life care and opinions about assisted dying in Canada.Chapter 2 reviews the legal status quo in Canada with regard to various forms of assisted death.Chapter 3 reviews ethical issues pertaining to assisted death. The analysis is grounded in core values central to Canada's constitutional order.Chapter 4 reviews the (...) experiences had in a number of jurisdictions that have decriminalized or recently reviewed assisted dying in some shape or form.Chapter 5 provides recommendations with regard to the provision of palliative care in Canada, as well as recommendations for reform with respect to the various forms of assisted death covered in this document. Video streaming has become very popular among game enthusiasts. Live streams of computer games, where there is the possibility of communi­cation, are developing as community meeting places; a number of social scientists are calling this a trend towards new online “third places”. To­day’s debate draws attention to the reproduction of a participation culture trough streaming, in the space of which everyone can express themselves creatively, share their opinion, experiences, and information. At the same time, there is a tendency towards the (...) capitalist appropriation of streaming by media businesspersons who stimulate the monetization of participation. Investigating the “sociality of streaming”, the authors highlight the supplementation of the “Let’s Play” discourse with topics from the current agenda, understanding live streams as public media arenas. In the public arenas of computer game live streams, the dramatization and selection of global or local news information in a specific media format takes place. The article demonstrates this phenomenon using the example of the corona­virus, the most prominent topic of spring 2020. The pandemic vocabulary appears in different sections of Twitch game streams, such as titles, audio/ video content, and the chat. Banter and obscene vocabulary are charac­teristic of the game stream space, however, this is combined with charity fund-raising broadcasts in support of doctors. ­. (shrink)

The study presents the Russian historical-philosophical process in the context of the discovery of a new object, themes, personae, set of reactions and formation of a product for the intellectual community. The author's reliance on philosophical empirical material and appropriate hermeneutics in its processing allows the author to highlight those factors that influenced individual and collective reception. The author sees as a convenient case study the “discovery” by the Russian philosophical community of the early 20th century of both American philosophy (...) in general and C.S. Peirce in particular. Since the beginning of the 19th century, Russian thinkers have turned their attention to American philosophy in all the diversity of its manifestations. Russian intellectuals paid special attention to American pragmatism and everything associated with it. In Russia, in addition to translations, numerous reviews of foreign publications on this topic are appearing. Of particular interest to us in the Russian “collective reflection” of American ideas is the system of preferences for ideas, texts, events, and names. The point is that what might have been a priority for a European thinker, for a Russian one turned out to be on the “periphery” of his consciousness, as well as vice versa. While James appeared among the priority figures for Russian thinkers, Peirce was in his “shadow”. Using rich empirical material, the author shows all the stages of Peirce’s image formation in the Russian intellectual community. The research shows that “image” of Peirce, which represents not so much the thinker himself, but characterizes the intellectual community that turned to him. The results of the study may be useful both for contemporary foreign and Russian interpreters of Peirce and for historians of philosophy who are rethinking the past and forming in the present new objects of reception and reflection. The research is devoted to justification of the interdisciplinary approach in the study of consciousness. Studying consciousness as a phenomenon is a very divergent project, the mystery of its nature and appearance makes different ways of studying consciousness possible. Besides, consciousness is an umbrella term which may be interpreted differently in different contexts. Various approaches to comprehension of consciousness have been developed nowadays in Philosophy, Psychology, Biology, Medicine, Neurosciences, Sociology, Cognitive and Computer Sciences, Linguistics and a number of other research (...) fields. In the end of the 1980s one can notice an exceptional growth of interest in the problem of consciousness both in Philosophy and Science. The works by Bernard Baars, Daniel Dennett, Roger Penrose, Francis Crick and Christopher Koch, David Chalmers have appeared in these years. They outlined the main approaches to the study of consciousness and demonstrated that study of consciousness became an interdisciplinarity research. The research discusses the features of the phenomenon of consciousness and outlines the main theoretical issues, the most relevant of which are the “hard problem” of consciousness, the problem of mind and body, the problem of “the explanatory gap”, the question of the primacy of the brain in relation to consciousness, the place of consciousness in the modern scientific paradigm, changes of the ethical and worldview interpretation in connection with artificial intelligence, neurochips and neural network. Based on the complexity and multidimensionality of the research field associated with the problem of consciousness, the variety of approaches to studying this problem in Philosophy and Science, the controversial character of the questions raised, and the heated discussion among researches, the author concludes that interdisciplinary studies of consciousness have the greatest heuristic possibilities today. Antimicrobial resistance is one of the greatest public health crises of our time. The natural biological process that causes microbes to become resistant to antimicrobial drugs presents a complex social challenge requiring more effective and sustainable management of the global antimicrobial commons—the common pool of effective antimicrobials. This special issue of Health Care Analysis explores the potential of two legal approaches—one long-term and one short-term—for managing the antimicrobial commons. The term sustainability has become one of the most significant in the current era. It seems to be ubiquitous amongst academics, politicians, business leaders, media personnel and even the general public. It is no exaggeration to state that it is considered all over the world to be the most pressing issue to be addressed for the long-term future of the planet and its inhabitants. The topic is of course complex, and the issue of sustainability is under much debate as to (...) what it actually is and how it can be achieved, but it is completely certain that the resources of the planet are fixed in quantity and, once used, cannot be reused except through being reused in one form or another. At present, much of the discourse of sustainability has focused upon the environment and in particular upon climate change and the effects that this is having. Thus, the discourse has tended to be about mitigation. Sustainability of course requires all three pillars of the triple bottom line—economic, environmental and social—to be addressed. Indeed, it might be considered that the effects upon the social, and how we choose to live our lives, might well be the most profound effect of achieving sustainability. This book therefore focuses upon some of the many aspects of the social and how we can adapt our lives to accommodate the requirements of sustainability. it therefore takes a very different approach to addressing the issues of sustainability, while of course not ignoring the other pillars. This book therefore sets out to examine various aspects of the changes to personal, corporate and institutional behaviour which may have to come about in our search for sustainability. It is tended to address some of the issues and how they are being dealt with in various parts of the world. As always, our concept is to share best practice and thereby enrich both the discourse and our progress towards sustainability. Thus, we focus upon the current situation while also considering the extent to which the focus is changing so much that we need to think about new approaches to our understanding of behaviour and differing effects in practice. The international origins of the contributors to this book make this an original contribution taking some of the best ideas from around the world. This book therefore addresses these issues from a perspective not generally addressed by researchers, or even by politicians and the press. It therefore provides fresh perspectives upon the important issue of our common future. As always, this approach is based on the tradition of the Social Responsibility Research Network srrnet.org (a worldwide body of scholars with membership of several thousand), which in its 20-year history has sought to broaden the discourse and to treat all research as inter-related and relevant to business. This tradition has always been to explore the subject widely and to seek relevant solutions, while also sharing best practice. To understand power relations, it is important to consider that power is an attribute, and whoever has it at a given moment is in the condition of dominant and whoever is under its exercise is dominated. Moreover, we must consider that these positions are interchangeable, changing when relations of force change. Power relations represent the pursuit of supremacy through knowledge, with struggles for better positioning in the social structure. In this study, we analyze the effects of disciplinary power on daily (...) practices of nurses and physicians in the hospital environment, more specifically in intensive care units. From the perspective of disciplines, power is exercised in a discreet, modest, calculated and permanent way, through the establishment of rules and norms. In this context, despite the strong appreciation of a medical‐centered model, it is observed that nurses gain visibility through knowledge and the defense of institutional norms and rules, which can generate tensions in daily professional practices.
